Terms of Service

Please read these Terms of Service ("Terms") carefully before using the MyCyberMerit website and certification services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Purpose of the Service
MyCyberMerit provides online cybersecurity certification exams. These certifications are designed to validate professional skills but do not constitute a state-recognized diploma unless explicitly stated.
2. Eligibility and Account
- Identity: You must provide accurate and verifiable information through our authentication providers (Clerk, LinkedIn, Google, GitHub).
- Single Account: Each user is allowed only one account. The use of "disposable" emails or fake identities to bypass exam rules is strictly prohibited and will lead to immediate disqualification.
3. Payment and Refund Policy
Processor: All payments are processed via Lemon Squeezy. By making a purchase, you agree to their terms and conditions.
No Refund upon Failure: The fee paid covers the administration and proctoring of the exam attempt. No refunds will be issued if a candidate fails the exam.
Right of Withdrawal: In accordance with Article L221-28 13° of the French Consumer Code (and similar international digital goods laws), the right of withdrawal cannot be exercised for digital content once the performance has begun (i.e., once you start the exam).
4. Exam Integrity and Conduct
To maintain the value of the MyCyberMerit certification, you agree to:
- Complete the exam personally without unauthorized assistance or AI tools.
- Not copy, record, or distribute exam questions or materials.
Any detected fraud will result in the permanent revocation of all certificates issued to the user without a refund.
5. Certification and Third-Party Providers
- Issuance: Certificates are issued via Certifier.io or Badges.parchment.com.
- Validity: MyCyberMerit reserves the right to revoke a certificate if it is later discovered that these Terms were violated.
- Verification: By using the Service, you authorize MyCyberMerit to confirm the validity of your certificate to any third party (e.g., an employer) who presents a valid verification link.
6. Limitation of Liability
- Service Availability: While we strive for 100% uptime on our VPS, we are not liable for temporary service interruptions.
- Career Results: MyCyberMerit does not guarantee employment or salary increases as a result of obtaining our certifications.
- Data Security: We implement industry-standard security measures via Clerk and our VPS, but no system is 100% secure.
7. Intellectual Property
All content, logos, exam questions, and platform architecture are the exclusive property of MyCyberMerit. Any unauthorized reproduction is subject to legal action.
8. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of France. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.
